OpenDreamnet S.A.S. de C.V. ("OpenDreamnet," "we," "our," and/or "us") values the privacy of individuals who use our application, websites (specifically OpenDream Upscale), and related services (collectively, our "Services"). This privacy policy (the "Privacy Policy") explains how we collect, use, and disclose information from users of our Services ("Users" "you," and/or "your") to provide AI-powered image upscaling and enhancement features, and to continue to improve our Services. By using our Services, you agree to the collection, use, disclosure, and procedures this Privacy Policy describes. Beyond the Privacy Policy, your use of our Services is also subject to our Terms of Service.
1. Information We Collect
We may collect a variety of information from or about you or your devices from various sources, as described below.
A. Information You Provide to Us.
Registration and Profile Information. When you sign up for an account, register to use our Services, or sign up for notifications or updates, we ask you for information such as your email address and a secure password.
Order and Payment Information. When you purchase "credits" on our platform, your payment-related information (such as credit card details, billing address, and transaction history) is collected and processed directly by our secure third-party payment processors. We do not store your full credit card numbers or raw payment details on our servers. We only retain basic order history (such as transaction IDs, amounts, and credit balances) to manage your account and fulfill your purchases. This strict separation ensures compliance with the high safety standards expected by major international payment gateways.
User Content (Images). To provide our core upscaling and denoising service, you upload photos to our servers. These photos are processed using the "Nano Banana Pro" AI, a service provided by Google. As such, any images and related information sent to their servers for processing are also subject to Google's Privacy Policy and terms. We do not use your personal images to train our own AI models, and you maintain full ownership of the content you upload.
Communications. If you contact us directly for support or inquiries, we may receive additional information about you, such as your name, email address, the contents of a message or attachments that you may send to us, and other information you choose to provide.
B. Information We Collect When You Use Our Services.
Usage Information and Metrics. To help us understand how you use our Services and to help us improve them, we automatically receive information about your interactions with our platform. For this purpose, we use Plausible Analytics, a privacy-friendly tool that does not rely on invasive tracking. This collects general metrics such as credits spent, number of images processed, session durations, and error logs if a process fails.
Device and Connection Information. We receive information about the device and network you use to access our Services, including your Internet Protocol (IP) address, web browser type, operating system version, and general location information inferred from your IP address to prevent fraud and comply with regional tax/payment regulations.
2. How We Use the Information We Collect
We use the information we collect for various purposes, including to:
- Provide, operate, and maintain our Services.
- Process transactions, manage your credit balance, and send related information, including purchase confirmations and invoices.
- Fulfill our obligations to payment processors regarding fraud prevention, chargeback handling, and secure transaction verification.
- Improve, personalize, and expand our Services.
- Understand and analyze how you use our Services.
- Develop new products, services, features, and functionality.
- Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the Service.
- Send you emails regarding your account (e.g., password resets, order receipts).
- Find and prevent fraud to ensure a secure environment for all users and comply with the strict security requirements of our payment gateways.
- Comply with legal obligations.
3. How We Disclose the Information We Collect
We only share your information in the following circumstances:
Payment Processors and Financial Partners. We share necessary data (like email and transaction identifiers) with our payment processors to securely process your purchases of credits, prevent fraudulent transactions, and manage refunds or disputes. This is required to maintain good standing with global payment networks.
Service Providers and Vendors. We may disclose any information we receive to vendors and service providers retained in connection with the provision of our Services. This includes cloud hosting providers, infrastructure partners, email delivery services, and the AI processing environments necessary to upscale your images.
As Required by Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to: (a) comply with law enforcement requests and legal process, such as a court order or subpoena; (b) respond to your requests; or (c) protect your, our, or others' rights, property, or safety.
Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.
4. Security and Data Retention
Security. We make reasonable efforts to protect your information by using physical and electronic safeguards designed to improve the security of the information we maintain. All data in transit is secured using modern cryptographic protocols (HTTPS/TLS). However, because no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the absolute security of your information.
Data Retention.
- Account Data: We retain your account information (email, hashed password, credit balance, transaction history) for as long as your account is active or as needed to provide you Services, resolve disputes, and comply with legal/tax obligations.
- Images: Uploaded and processed photos are kept temporarily to allow you to download them. You have the ability to "Delete all" from your dashboard at any time, which will remove the files from our active servers.
5. Your Choices and Rights
Account Management. You can access, review, modify, or delete your account information at any time by logging into your account settings. When you request account deletion, we will remove your personal data, though we may retain certain transactional records as required by law or for legitimate business anti-fraud purposes.
Communications. You can opt out of receiving promotional emails by following the unsubscribe link in those emails. Even if you opt out of promotional messages, you will continue to receive essential administrative messages, such as receipts, password resets, and important policy updates.
6. Age Requirements and Children's Privacy
Our Services are strictly intended for adults. You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use our platform. We do not permit minors to use the Services, and we do not knowingly collect personal information from anyone under the age of 18. If you are a parent or guardian and discover that your child has provided us with personal information, please contact us immediately, and we will take steps to securely delete that data and terminate the account.
7. International Users
OpenDreamnet S.A.S. de C.V. is based and operates in Mexico. Our Services are hosted on international cloud infrastructure. If you choose to use the Services from regions outside of Mexico (such as the United States or the European Union), please note that you are transferring your personal information outside of those regions to our servers and third-party processors. By providing any information to the Services, you consent to such transfer, storage, and processing subject to this Privacy Policy.
8. Changes to this Privacy Policy
We will post any adjustments to the Privacy Policy on this page, and the revised version will be effective when it is posted. The "Last Updated" date at the top of this policy reflects the most recent changes. If we materially change the ways in which we use or disclose personal information previously collected from you, we will attempt to notify you through the Services, by email, or other communication.
